The Unitary Patent on the final straight: Bulgaria ratifies the UPC Agreement


Bulgaria last week became the tenth signatory state to pave the way for the Unified Patent Court to begin its work and hence for the Unitary Patent to take effect in Europe.

The National Assembly in Bulgaria passed the necessary laws for the ratification of the Agreement on a Unified Patent Court. All that still remains to be done for the ratification to take effect is for the instrument of ratification to be deposited in Brussels, which is due to happen shortly.

This means that only three of the requisite thirteen ratifications by the signatory states to the agreement are still outstanding; at least Germany and the United Kingdom still need to ratify before things can start moving. A withdrawal of the United Kingdom from the European Union (Brexit) would, however, lead to serious delays. Everyone is therefore waiting with bated breath for the outcome of the British referendum in June.
